  8. This agreement between The Birdsong Company herein called TBC and
  9. the person or organization named as "Licensee", herein called
  10. Licensee, is the full understanding between TBC and Licensee.
  11.  
  12. TBC grants to Licensee a, non-exclusive, non-transferable, 
  13. non-assignable license to use software known as "Waffle File
  14. Server", herein called WFS.  Title to WFS and its documentation 
  15. belong to TBC.
  16.  
  17. A license is required for each machine on which WFS is run.
  18.  
  19. The License for individuals in the USA is $20.00 US where payment is
  20. made by check in US Dollars drawn on a US branch of a US bank.
  21.  
  22. The License for individuals not in the USA is $25.00 US where payment
  23. is made by check in Non-US denominated funds, drawn on a Non-US bank.
  24.  
  25. Licensee will pay TBC a one-time fee of ________ Dollars ($________)
  26. for the license to use WFS.
  27.  
  28. Licensee may make a reasonable number of copies of WFS for back up
  29. and recovery purposes.

  31. Licensee may not reverse engineer WFS.
  32.  
  33. TBC provides WFS "As Is" and disclaims all warranties relating to this
  34. software, express or implied, including without limitation any
  35. implied warranties of merchantability or fitness for a particular
  36. purpose. TBC will not be liable for any special, incidental,
  37. consequential, indirect or similar damages due to loss of data or any
  38. other reason, even if TBC has been advised of the possibility of such
  39. damages.  In no event shall TBC's liability for any damages ever
  40. exceed the price paid for the license to use the software. 
  41.  
  42. This Agreement, and all amendments, modifications, alterations, or
  43. supplements, shall be governed by the law of the State of California.
